1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the OATHERA websites and services (the "Services"). By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The Services

OATHERA provides an agentic identity platform that issues and verifies cryptographic identities for AI agents. We may update, improve, or modify the Services over time. Some features may be offered in beta and provided "as is".

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorised use.

4. Acceptable use

You agree not to:

• Use the Services unlawfully or to infringe others' rights.
• Attempt to disrupt, probe, or circumvent the security of the Services.
• Reverse engineer the Services except as permitted by law.
• Resell or provide the Services to third parties without authorisation.
• Upload malware or use the Services to harm others.

5. Customer data

You retain all rights to data you submit to the Services. You grant us a limited licence to process it solely to provide and secure the Services. Our processing of personal data is governed by our Privacy Policy and Data Processing Agreement.

6. Intellectual property

The Services, including all software, designs, and content provided by OATHERA, are owned by OATHERA and its licensors and are protected by intellectual-property laws. These Terms grant you no rights except the limited right to use the Services as described.

7. Third-party services

The Services may interoperate with third-party products. We are not responsible for third-party services, and your use of them is governed by their own terms.

8. Fees

Paid plans are billed as described in the applicable order or plan. Fees are non-refundable except as required by law or expressly stated.

9. Warranties and disclaimers

Except as expressly stated, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, OATHERA will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising from the Services will not exceed the amounts you paid to us in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold OATHERA harmless from claims arising out of your use of the Services or your breach of these Terms, except to the extent caused by OATHERA.

12. Term and termination

These Terms apply while you use the Services. We may suspend or terminate access for breach or to protect the Services. You may stop using the Services at any time. Terms that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which OATHERA is established, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction.

14. Changes

We may revise these Terms from time to time. Material changes will be posted here with a revised "Last updated" date. Continued use after a change constitutes acceptance.
